Refund and Returns Policy - KILLIT PTY LTD

1. Introduction
KILLIT PTY LTD ("we", "our", "us") is committed to delivering premium-quality pre-workout gummies that support our customers' fitness goals and overall well-being. We operate in strict compliance with the Australian Consumer Law (ACL) under the Competition and Consumer Act 2010 (Cth), as well as all other relevant consumer protection legislation. This Refund and Returns Policy (the "Policy") governs the circumstances under which KILLIT PTY LTD will accept returns, provide remedies, and outlines the conditions under which no refunds will be issued. By purchasing our products, you ("you", "your") agree to the terms and conditions set out in this Policy.

2. No Refunds Policy
KILLIT PTY LTD operates a no-refund policy, except as required by law. No refunds will be issued once a product has been purchased, regardless of whether the product is opened or unopened. This applies to all sales, including but not limited to pre-workout gummies and related products. All sales are final.

By completing your purchase, you acknowledge and accept that no refund will be granted except under the limited circumstances outlined in this Policy or as required by applicable statutory law.

3. Consumer Guarantees Under Australian Consumer Law (ACL)
Under the Australian Consumer Law (ACL), part of the Competition and Consumer Act 2010 (Cth), you, as a consumer, are entitled to certain guarantees regarding the goods you purchase. These guarantees are independent of any other terms and conditions and cannot be waived. Specifically, under Section 54 of the ACL, a product must meet the following consumer guarantees:

  • Acceptable Quality: The product must be of a standard that a reasonable consumer would expect (Section 54, ACL).
  • Matching the Description: The product must match the description provided at the time of purchase (Section 56, ACL).
  • Fitness for Purpose: The product must be suitable for the purpose it is commonly used for (Section 55, ACL).
  • Major Faults: If the product has a major defect, you are entitled to a remedy (Section 54, ACL).

If your product does not comply with the statutory guarantees outlined in the ACL, you may be entitled to a remedy, such as a repair, replacement, or credit. However, change of mind or dissatisfaction with the product, which does not fall under the above guarantees, will not entitle you to a remedy.

4. Faulty or Defective Products
If you believe that a product purchased from KILLIT PTY LTD is faulty, defective, or does not meet the product description, you must notify us in writing within 7 days from the date of receipt of the product. The product will be assessed in accordance with Section 54 of the ACL, and we will determine whether a remedy (repair, replacement, or credit) is appropriate.

For your claim to be processed, we require the following documentation:

  • Proof of purchase (order number, invoice, or receipt).
  • A detailed description of the defect, fault, or non-compliance with the product description.
  • Photographic evidence (if applicable).
  • The product must be returned in original packaging (if applicable), and in unopened or unspoiled condition (if appropriate).

Once we verify that the product is faulty or defective, we will offer the following remedies:

  • A repair of the defective product.
  • A replacement of the defective product.
  • A credit for the value of the product.

If the product is faulty or defective, KILLIT PTY LTD will bear the cost of return shipping. However, if the defect or fault is a result of improper use, mishandling, or failure to follow storage instructions, no remedy will be provided.

5. No Refunds for Melting or Temperature-Related Issues
Due to the heat-sensitive nature of our pre-workout gummies, KILLIT PTY LTD does not offer refunds for melting, warping, or any other temperature-related issues. It is the responsibility of the customer to ensure proper storage conditions for the products. All products must be stored below 25°C at all times. Products stored at temperatures above 25°C may suffer from melting, warping, or other temperature-related damage, and KILLIT PTY LTD will not accept returns or provide refunds for products that have been affected by temperature exposure.

By purchasing from KILLIT PTY LTD, you acknowledge and accept full responsibility for the proper handling, storage, and consumption of the product.

6. Change of Mind
KILLIT PTY LTD does not offer refunds or exchanges for change of mind. If you decide that you no longer want the product, we will not process a return or provide a refund. We strongly encourage all customers to carefully review the product descriptions, ingredients, and specifications before completing their purchase. Once your order is placed, it is considered final.

7. Incorrect Delivery Details
It is the customer’s responsibility to ensure that the delivery details provided at the time of purchase are accurate and complete. KILLIT PTY LTD is not liable for any delays, non-deliveries, or additional charges resulting from incorrect or incomplete shipping information. If a product is returned to us due to incorrect or incomplete address details provided by you, we will require payment of an additional shipping fee to resend the product.

8. Delivery Charges
Delivery charges are non-refundable, except in cases where the product is faulty, defective, or incorrect. In such cases, the customer will be reimbursed for the return shipping charges. In all other circumstances, the customer is responsible for the cost of returning the product.

9. Exemptions for Certain Products
In accordance with Section 54 of the ACL, the following products cannot be returned under any circumstances:

  • Opened or used products (for hygiene and safety reasons).
  • Products that have been exposed to temperatures exceeding 25°C, resulting in damage.
  • Consumable products that have been partially or fully consumed.
  • Products that have been damaged or mishandled by the customer.

These exemptions are in place to comply with ACL regulations, which limit return eligibility in cases where products are misused or improperly handled.

If you believe your product is faulty, defective, or incorrect, or if you have any other concerns regarding your order, please contact our customer service team at killitau@gmail.com within 7 days of receiving your order. Upon receipt of your claim, we will evaluate it in accordance with this Policy and Australian Consumer Law (ACL).

11. Governing Law
This Refund and Returns Policy is governed by the laws of Australia, including the Australian Consumer Law (ACL), the Competition and Consumer Act 2010 (Cth), and other applicable consumer protection laws. Any disputes arising from this Policy will be subject to the jurisdiction of the courts of Australia.
